These terms govern your use of the itAtlas application and website (the "Service"), operated by Brendan Faulds (ABN 48 752 572 088) ("we", "us"). By using the Service you agree to these terms.
itAtlas is a local-first configuration-management and enterprise-architecture tool that runs in your web browser. Your data is stored on your own device, not on our servers.
You are solely responsible for your data and for maintaining your own backups. Because your data lives on your device, actions such as clearing your browser storage, device failure, or losing your backup passphrase can result in permanent data loss that we cannot recover or reverse. We strongly recommend keeping current, safely-stored backup files.
Paid plans are offered on a subscription basis by record tier as described on our pricing page. Fees are stated in Australian dollars and are exclusive of GST unless stated otherwise. Where the Service is offered free of charge or in preview, we may change plans, features and pricing before general availability. We will make billing terms available when paid plans commence.
You agree not to misuse the Service, including by attempting to circumvent access or subscription controls, reverse-engineer the Service other than as permitted by law, or use it unlawfully or to infringe others' rights.
The Service, including its software, design and content, is owned by us and licensed to you, not sold. You retain all rights in the data you create; we claim no ownership of it (and, being local-first, hold no copy of it).
We aim to keep the website and app available but do not guarantee uninterrupted access. Because the app runs locally, it continues to function on your device independently of our website's availability.
The Service is provided "as is" and "as available". To the maximum extent permitted by law, we exclude all implied warranties. Nothing in these terms excludes rights you have under the Australian Consumer Law that cannot lawfully be excluded. To the extent permitted by law, our total liability arising out of or in connection with the Service is limited to the amount you paid us for the Service in the twelve months preceding the claim.
You may stop using the Service at any time. We may suspend or terminate access if you breach these terms. Since your data resides with you, termination does not delete your local data or backups.
These terms are governed by the laws of South Australia, Australia, and you submit to the non-exclusive jurisdiction of the courts of that state.
